1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of PodControl, including podcontrol.app and related services (the "Service").

By creating an account, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Eligibility and Accounts

You must be legally capable of entering a binding contract to use the Service.

You are responsible for account credentials, account activity, and ensuring your account information is accurate and current.

3. Subscription, Billing, and Taxes

Paid features are billed on a recurring basis unless canceled. Prices are listed on the pricing page and may change with advance notice.

You authorize PodControl and its payment processors to charge your selected payment method for all fees and applicable taxes.

4. Acceptable Use

You may not use the Service for unlawful activity, infringing content, malicious interference, credential abuse, security testing without authorization, or attempts to access data not intended for you.

You may not reverse engineer, scrape at abusive rates, or disrupt Service performance for other users.

5. Your Content and Licenses

You retain ownership of content you upload or submit, including audio, transcripts, notes, metadata, and media assets ("User Content").

You grant PodControl a limited license to host, process, transmit, and display User Content only as needed to provide, secure, and improve the Service.

6. AI-Generated Output

The Service may generate transcripts, summaries, titles, descriptions, social copy, and other AI-assisted output. You are responsible for reviewing output before publication or distribution.

PodControl does not guarantee accuracy, completeness, or fitness of AI output for any specific purpose.

7. Third-Party Integrations

The Service can connect with third-party providers (for example Google, X, LinkedIn, payment providers, storage, and meeting services). Your use of those providers remains subject to their terms and policies.

PodControl is not responsible for third-party outages, policy changes, or acts and omissions outside PodControl's control.

8. Intellectual Property

PodControl and its software, branding, interfaces, and documentation are protected by intellectual property laws.

Except for rights expressly granted in these Terms, no rights are transferred to you.

9. Suspension and Termination

PodControl may suspend or terminate access if you violate these Terms, create security risk, or expose PodControl or other users to legal or operational harm.

You may stop using the Service at any time. Provisions that by nature should survive termination will survive.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

PodControl does not warrant uninterrupted operation, complete security, or error-free functionality.

11. Limitation of Liability

To the maximum extent permitted by law, PodControl and its affiliates are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or goodwill.

PodControl's total liability for claims arising out of or related to the Service is limited to amounts paid by you to PodControl during the twelve months before the event giving rise to the claim.

12. Changes to These Terms

PodControl may update these Terms from time to time. Material changes will be posted with an updated effective date.

Continued use of the Service after updates take effect means you accept the revised Terms.
